Oakville Tree Removal Permit: The 15 cm Rule, the Fees, and When Pruning Skips It

When you actually need a permit in Oakville

Oakville protects private trees under its Private Tree Protection By-law (By-law 2017-38, updated in 2024). The trigger is size. Any privately owned tree measuring 15 cm or more across the trunk (about 6 inches), measured at 137 cm off the ground, needs a permit before it comes down.

That threshold is low, and it is the whole story in Oakville. For comparison, Toronto's private-tree rule only kicks in at 30 cm. Oakville catches trees at half that size, and it has been tightening the rules, not loosening them. The 2024 update made the bylaw harder to work around, which tells you how seriously the town takes its tree canopy. A backyard maple, a front-yard spruce, most things a homeowner pictures when they say "a real tree" clear 15 cm easily.

Oakville is not alone in setting the bar at 15 cm. Neighbouring Mississauga uses the same 15 cm threshold, so if you own property in both towns the rule of thumb is the same. Just east, Burlington sets its bar at 20 cm, between Oakville's 15 and Toronto's 30. What sets Oakville apart is the replacement obligation, which we get to below.

Want to check your own tree before you call anyone? Wrap a tape measure around the trunk at chest height, then divide that number by about 3.14. That is your diameter. If it lands at 15 cm or more, plan on needing a permit.

The bylaw also covers trees you were required to plant or keep as a condition of a development or site plan, no matter their size. Quick way to read it:

• Permit needed: any private tree 15 cm or more across the trunk, plus trees tied to a site-plan or development condition.
• Usually no permit: a tree under 15 cm across, measured at chest height (still worth confirming).
• Special cases: dead, high-risk, ash, and buckthorn trees still need a permit, but the fee is waived (more on that below).

What the permit costs you, in money and in time

There are two costs here, and both sit on top of the tree work itself. There is the town application fee, and there is your time waiting on the inspection.

• $65 for the first tree, if it measures 15 to 24 cm across.
• $425 for each additional tree, and for any tree larger than 24 cm across.
• No fee for dead, high-risk, ash, or buckthorn trees. They still need a permit, but the application fee is waived.

Then there is the Oakville catch most people do not see coming: replacement trees. One new tree has to be planted for every 10 cm of healthy trunk you remove, with a $300 security deposit for each replacement tree. Take down a healthy 40 cm maple and you are on the hook for four new trees plus the deposits. The 2024 update also pulled cedar off the list of acceptable replacements and limited the option of paying cash instead of replanting, so the town really does want trees back in the ground.

On timing: a town tree inspector contacts you within five business days to set up an on-site visit. Realistically, plan for a couple of weeks start to finish, and longer through the busy spring season when the forestry section is buried. What happens if you skip it

Removing a protected tree without a permit is a bylaw offence in Oakville. The town handles non-compliance through its Administrative Penalty system, and it can require restoration and replanting on top of any penalty. This is not a town that looks the other way on trees.

The real cost is bigger than the penalty. The town can order replacement trees, and an unpermitted removal has a way of surfacing later, during a property sale or a building-permit review, which is an expensive surprise at the worst possible moment.

Do not count on nobody noticing, either. Neighbours report removals, and a sudden bare patch where a mature canopy used to stand is about as easy to spot as it gets.

The part most homeowners miss: you might not need a removal at all

Here is the thing the search query hides. People look up the Oakville tree removal permit because they have a problem they want gone. A limb hanging over the roof. A tree dropping mess on the deck. Roots crowding the patio. Too much shade on the garden.

Removal is the biggest, slowest, most regulated answer to all of those. Often it is the wrong one.

Pruning is not a removal. Cutting back, thinning, or shaping a tree you are keeping does not trigger the removal permit at all. A good prune fixes most "this tree is a problem" complaints without the permit, the fee, or the replacement obligation. One bad branch is a limb-removal job, not a tree removal. And a young tree under 15 cm across usually is not protected in the first place, so it can often come out without a permit (confirm the measurement first).

A real example of how this plays out: a homeowner calls about a big silver maple shading the whole backyard and dropping seeds everywhere, convinced it has to go. Nine times out of ten the fix is a crown thin and a couple of low limbs off, which lets light through and stops the mess, with no permit and no replacement trees owed. The tree stays, the problem is gone, and the bill is a fraction of a permitted removal. Sometimes removal really is the answer. A dead tree, a failing trunk, a species planted in the wrong spot. When that is the case you need the permit and an arborist report, and we will tell you so plainly rather than talk you into a prune that will not hold.
